Earning Potential Impacts Divorce

In a divorce, the financial aspects of your ex spouse will have a bearing upon multiple factors such as spousal support and child support. FoxNews is reporting that in the messy high profile divorce of NJ Governor McGreevey, he is claiming that he is broke and not able to support wife in the lifestyle she is accustomed post divorce.

While this argument may be convincing in some circumstances, another factor the court often considers is the other spouses earning potential. Are they living up to their earning potential in future jobs and earning prospects. That will have to be left for the courts to decide in determing spousal support and child support for his ex wife.
